Petition to review proceedings of Board in the hopes that this decision might be reversed
According to Putnam County Mayor Randy Porter, the County has filed suit against TN Health Facilities Commission of Middle TN, and Cedar Recovery LLC concerning the establishment of the proposed Methadone Clinic on 1806 Burgess Falls Road.
“The State of TN had filed a motion to dismiss the case or move the hearing to Davidson County. On July 18th, Chancellor Ron Thurman ruled in favor of Putnam County and stated, ‘the court finds that jurisdiction and proper venue for this action lies in Putnam County,’” according to Porter.
Porter says this is just the beginning.
“This is only the beginning for the case and any future updates will be provided as they happen,” said Porter.
Following a 2024 August meeting with THFB, which voted 6-2 to allow the proposed clinic, the County immediately announced a lawsuit to fight the result. The petition, which Porter says was filed to “review the proceedings of the Board in the hopes that this decision might be reversed” states the location is not beneficial to CR’s customer base, and that the Upper Cumberland doesn’t have a big enough need and that Cedar Recovery has not shown enough success in stopping addiction through the distribution of Methadone.
Need, quality and consumer or patient advantage are the criteria the commission had to consider, according to state statute.
Methadone is a schedule 2 drug, the same as hydrocodone. Porter has dedicated the county to fight against the clinic and wants citizens to understand that the fight is not over
He has stated the county will use every tool at its disposal to stop the clinic from opening.
“We will continue to explore all options that may be available to keep our county as safe as it possibly can be,” said Porter.
